ASSURED BUY BACK SCHEME - TERMS AND CONDITIONS

Terms & Conditions of buy-back (as provided by Trusterra to Customers)

OVERVIEW

This buy-back program shall be called “Assured Buy Back” and is offered by Trusterra Technologies Private Limited.

The buyback value provided on the vehicles shall be 60% or 50% of the effective ex-showroom value of the Vehicles (i.e. actual ex-showroom value plus AtherStack™Pro  Price less the central subsidy amount applicable) for buy-back undertaken at the 36th or 48th month respectively. The final buy-back value percentage shall be calculated and provided based on the condition of the Vehicle as determined in the inspection process.

A.ELIGIBILITY TERMS

The following terms are the eligibility criteria to be able to avail the Assured Buy Back program; Any failure to meet these criteria shall render a customer ineligible for availing the buyback:

  1. The program can be redeemed only at the start of the 35th/47th month ending at 36th/48th month (from the actual invoice date).

  2. The vehicle should NOT have traveled more than 36,000 kms (at the end of 36 months)/ 48,000 kms (at the end of 48 months) at the time of redemption of the program      

  3. The vehicle should have been maintained as per the service schedule and maintenance instructions prescribed by OEM from time to time, within the program time. The customer may be asked to share the screenshots (if required by Trusterra).

  4. Only the first and original RC owner of the Vehicle can only avail the benefits under the said program.         

  5. The vehicle should not have been used for commercial/off-roading/racing purposes at any time within the program.

  6. If it's a financing case i.e. the Vehicle has been purchased with a loan/ on credit, any outstanding loans or hypothecation/charge/pledge at the time of redemption of the program has to be settled between the customer and the financier. If not cleared, the vehicle shall not be eligible for the Assured Buyback.

  7. The vehicle should have all the original documents (Registration Certificate,  Insurance, Invoice etc.) valid and in order as per applicable law at all times and need to present the same for the redemption of the program.

  8. The Assured Buyback Scheme shall only be available for Ather Vehicles purchased with a AtherStack™ Pro or else on purchase of Ather 450 Apex.

  9. Vehicle VIN, chassis number, motor serial number, software, and odometer should not have been tampered with at any time, leading to the redemption of the program becoming invalid.

  10. The Vehicle was not billed/ invoiced by Ather or its authorised retail partners.

  11. In case of any challan pending on the Vehicle at the time of redemption of the program; It is clarified that if the customer clears such challan, it will be eligible once again.

  12. In case any additional material modifications found in the Vehicle or any comment on Additional Modifications found in DMS Service history;

  13. In case of physical modifications is done to the vehicle (repaint / after-market parts that results in voiding of the Vehicle warranty.

  14. If the battery SOH should fall below 70% at the time of ABB claim, then Ather will facilitate the replacement of the battery provided the vehicle is under warranty at the time of claim.  

B. EVALUATION TERMS

The vehicle will be subject to inspection, testing, and evaluation by the technical experts designated by Trusterra on the basis of various criteria including the ones stated below, before determining the eligibility for redemption and the value of redemption eligible for the vehicle:

  1. Damage to the Vehicle parts or defects arising as a consequence of:

    1. Normal wear and tear of the vehicle will be accepted. The vehicle will undergo through a detailed inspection/checks basis the agreed evaluation matrix between Ather and Trusterra. In case there are any damages in the vehicle, there will be deductions as per the evaluation matrix and the revised ABB quote will be shared by the Trusterra team with customer    
    2. Theft of the vehicle or damage due to vandalism.
    3. Improper storage or use of vehicles other than normal use, leading to damage or deterioration of the condition of the vehicle; "exposed to sunlight/rain or water logging, because of vehicle being parked outdoors for extended periods”.
    4. Modification of any technology or software incorporated in the Vehicle; customer should not add/fix any aftermarket products which may adversely impact the vehicle performance.
    5. Installation or use of any equipment or accessory not sold or approved by OEM, including without limitation, any charging equipment or vehicle accessories.
    6. Performing any illegal activity(ies) using the Vehicle or its parts including but not limited to track violations and/or involved in causing track accidents leading to a third party insurance claim.
    7. Lifting the Vehicle at the wrong points, or other damage caused by or while transporting the Vehicle or parts by any means.
    8. An act of God or environmental factors, including earthquake, war, terrorist attack, exposure to sunlight, airborne chemicals, tree sap, animal or insect droppings, road debris (including stone chips), industrial fallout, rail dust, salt, hail, floods, wind storms, acid rain, fire, water damage, contamination, lightning, animal or rodent related damages, and other environmental conditions.
    9.  Exposing the battery to direct flame or flooding of the battery.
    10. Overloading Vehicle beyond the limits prescribed in the user manual; the same to be ascertained during the vehicle inspection and evaluation from the impact on vehicle suspension and areas where the overloading has taken place.
    11. Failure to charge the battery at regular intervals / as advised by the OEM in the user manual.
    12. Insufficient ventilation/choking/insulation of heat dissipating components arising due to negligence or non-compliance with maintenance requirements under the user manual.
    13. Failure to report any defects in any warranted parts to the OEM (as prescribed in the user manual).

  2. In case the vehicle or its parts have been assembled, disassembled, serviced, repaired, or modified by any unauthorized person, in any manner, or using parts or tools not authorized by OEM.
     
  3. The vehicle should not have any cases from or dues to any government authorities/bodies and should not be involved in any legal proceeding viz. FIR, Court case etc at the time of redemption of the Assured BuyBack Scheme.

  4. The vehicle should have no pending accidental or insurance claims. In addition to the above, for the vehicle to qualify for Assured Buyback, two conditions should be valid: (a) the vehicle should be in running condition at the time of availing the scheme (b) replacement of spare parts, if any, done post-purchase should be done through the OEM only.

  5. Once the Buyback offer is being communicated to the customer from Trusterra, the customer will have a window of 7 days/ 100 kms to confirm back on the offer made. In case the registered owner of the vehicle is not happy with the buyback offer made by Trusterra, the owner will have to take back his vehicle within stipulated time as mentioned above from when the customer confirms that he does not wish to go ahead with the offer. Trusterra will not be liable for any loss, damage caused to the vehicle whatsoever.

C. REQUIREMENTS

  1. The portable charger (if provided by the OEM at the time of sale) needs to be returned at the time of buy-back. If the charger is not returned/ damaged, then the value of the charger will be adjusted against the buyback value of the Vehicle.
  2. The vehicle should be returned in the city where delivery was taken and at Trusterra or its partner designated location (as published from time to time). In case of a valid transfer of registration, the same shall be accepted and the vehicle can be returned to the designated location in the current registration location. 
  3. Once the authorized Trusterra representative is satisfied with the condition of the vehicle in accordance with the agreed terms and conditions and the documents submitted, and at the discretion of Trusterra, will make a limited period offer to buy the vehicle. The customer will have a window of 7 days/100 kms to confirm on the Assured buyback offer being made by the Trusterra team.
  4. The Customer then has an option to agree to the price offered ( as per the Assured buyback certificate) or decline the offer at their own discretion.
  5. All Vehicle related documents (insurance, as provided in Annexure) in original should be submitted.
  6. The vehicle should have been purchased with an AtherStack™ Pro pack or else, an Ather 450 Apex.                          

Evaluation of Vehicle – includes but is not limited to the parameters listed hereunder:

  1. Vehicle Documents

    1.  Insurance copy and validity
    2. Original RC
    3. Compare VIN and Chassis details
    4. Check ownership for any transfer, since the ABB is only for the first owner.    
    5. Hypothecation to be checked on the RC, with a copy of the NOC from financier

   2. Riding Experience

    1. No unwanted noise
    2.  No unwanted vibration
    3.  No play in the front wheel
    4.  No play in the rear wheel
    5.  Smooth start and smooth stop
    6. Throttle reaction is adequate

    3. Exteriors

    1. Number plates in order
    2. Rear view mirrors in order
    3. Scratches – not more than 3 and less than 1 inch in length and less than 1mm thickness - Paint Quality
    4. Main stand and side stand
    5. Quality of seat cover is good
    6. Any signs of welding done on the vehicle
    7. Accessories matching to what was provided at the time of sale of vehicle (check invoice) 

    4. Brakes

    1. Ease / Smoothness in braking
    2. Noise while braking
    3. Quality of Disk/Drum

    5. Suspension

    1. Fork smoothness
    2. Rear suspension smoothness

    6. Tyres

    1. Quality of the Rim
    2. No cuts and bubbles on the tyres
    3. Quality of tyres

    7. Electrical

    1. Odometer
    2. Horn
    3. Dashboard
    4. Indicators
    5. Brake light
    6. Headlights
    7. Wiring insulation
    8. Battery SoH based on the data provided by OEM
    9. Battery Parameters based on the data provided by OEM

     8. Other Terms .

    1. The program is available in a city/State only if it is permitted as per local applicable laws and rules.
    2. Any of the terms and conditions applicable for the Assured BuyBack scheme may be updated herein only with the mutual consent of the Parties in writing.
    3. Buyback price determined by Trusterra upon evaluation of Vehicle at the time of redemption shall be final and binding.
    4. Any interpretation of the Terms under the Program shall be made by Trusterra and be binding.
    5. The program shall be subject to laws of India and jurisdiction of the courts of Delhi.
    6. Apart from the other terms and conditions for the Assured buyback program, at the time of claim, the Trusterra team for the vehicle evaluation will follow an evaluation matrix as below which is being agreed both between Ather and the Trusterra team.
